EPA Announces Annual Pesticide Maintenance Fee Forms Available For Download From EPA Website – Payment Deadline Jan 18, 2022 | Bergeson & Campbell, CP
the January 18, 2022, the deadline for paying the United States Environmental Protection Agency (EPA) annual maintenance fee for pesticide registrations is approaching. Section 4 (i) (1) (A) of the Federal Insecticides, Fungicides and Rodenticides Act (FIFRA) requires that any person holding an active or suspended pesticide registration granted under Sections 3 and 24 (c) FIFRA (Special Local Needs) pays an annual maintenance fee to keep the registration in effect. The maintenance fee requirement does not apply to additional distributor registrations, which are identified by a three-part registration number.
The fees for 2022 is $ 3,660 for each entry up to the maximum fees that may be imposed on a single registrant. Each registrant of a pesticide must pay the annual fee and email the response to the EPA no later than Tuesday, January 18, 2022. Unpaid registrations will be canceled, by order and without a hearing. As in years past, payment must be made electronically online at www.pay.gov.
For some qualified small businesses, the first product registration maintenance fee may be reduced by 25%, if the applicant meets the following criteria:
- The applicant has 500 or fewer employees worldwide;
- During the three-year period preceding the most recent maintenance fee billing cycle, the applicant has an average annual gross revenue from all sources that does not exceed $ 10 million; and
- The applicant holds a total of five registrations or less subject to the maintenance fee.
There are also maintenance fee waivers for products that meet the criteria of two specific categories: minor agricultural products and public health pesticides. The procedure for requesting fee waivers for individual products is described in the instructions provided by the EPA.
