FEMA Risk Mitigation Program Grant Application Public Notice (35)

The stormwater division of Metro Water Services applied for funding from the Federal Emergency Management Agency (FEMA) Flood Mitigation Assistance Program (FMA) through the Emergency Management Agency. Tennessee Emergencies (TEMA) as a sub-recipient.

Under the National Environmental Policy Act (NEPA), federal actions must be reviewed and evaluated for feasible alternatives and for social, economic, historical, environmental, legal, and security considerations. Under Executive Decrees (EO) 11988 and EO 11990, FEMA is required to consider alternatives and provide public notice of any proposed action in or affecting floodplains or wetlands. EO 12898 also requires FEMA to provide the opportunity to participate in the planning process and consider potential impacts on minority and low-income populations. This notice may also meet the requirements of Section 106 of the National Historic Preservation Act (NHPA).

Funding for the proposed project will be conditional on compliance with all applicable federal, tribal, state and local laws, regulations, floodplain standards, permit requirements and conditions.

Location of proposed work: within Davidson County limits. The property is located in the following area.

One (1) property is the Coopertown Farm area located west of Whites Creek Pike and east of I-24. The property is located in the floodplain / Redding Creek diversion channel.

Special zone of flood risk zone

This project involves the acquisition and demolition of one (1) property located in the AE flood zone. Confirmation of location in an SFHA was made by referring to the latest Flood Insurance Rate Map, panel 47037C0025H. The proposed work complies with all applicable regulations of the State of Tennessee and local floodplains. The proposed work will consist of acquiring and demolishing the property in the floodplain / diversion channel and will have no effect on the local floodplain. The action will be mitigated by removing structures in the floodplain / diversion channel and returning the property to open space and preventing future loss of life and property.

Proposed work and objective

The Metropolitan Government of Nashville and Davidson County is requesting funds to acquire and demolish one (1) property in the floodplain / diversion canal and return the property to open space. The aim of this project is to protect future loss of life and property from flooding.

Alternatives to the project

Alternative 1 (No Action Alternative): Taking no action would result in these homes remaining in highly flood prone areas, as well as a designated floodplain. Repetitive flood losses could still occur, placing a strain on the landowner, as well as on local government resources. If this structure persists, it would be an obstacle to the efforts of our departments and Metro to gradually mitigate the county’s highest potential flood loss area. It would also not provide financial aid and assistance to the homeowner whose home suffered significant property damage.

Alternative 2: The most feasible action is to acquire, demolish and return one (1) property in an open space, which would reduce loss of life and property in that area. This measure would not put our public safety officers at risk in future floods.

Alternative 3: The elevation would prevent the structure from being damaged during a 100-year flood. However, the costs associated with raising the existing structure would be at least $ 60,000.00 per structure. This is a conservative estimate and does not take into account that this structure has suffered damage to such an extent that elevation is not even possible. Therefore, elevation is not seen as a practical alternative to acquisition and demolition and restriction of land use. Even if the house would be raised, the property would still be at risk of property damage and physical danger to the owner in the event of future flooding. The homeowner would still be in danger if the floodwaters prevented him from leaving his home safely and in a timely manner, which would require rescue efforts and expense. There are also environmental problems associated with flooding, such as backflow of sewers, hazardous materials floating upstream, etc. The elevation would also reduce the option of gradually integrating the land into a greenway project or a neighborhood park. Either of these options would ultimately benefit a larger portion of the community with little additional annual cost.

Comment period

Comments are solicited from the public; local, state or federal agencies; and other interested parties to review and assess the impacts of the proposed project. Comments should be in writing and addressed to the Metropolitan Government of Nashville and Davidson County. All comments are due within 30 days of such notice. The Nashville and Davidson County Metropolitan Government will forward comments to the appropriate regulatory bodies as needed.
